What Happens Depends Entirely on the Parents' Nationalities

Japan follows jus sanguinis (nationality by descent) rather than birthright citizenship — being born on Japanese soil does not, by itself, make a baby a Japanese national. What your baby is entitled to depends on whether one or both parents are Japanese nationals.

Filing the 出生届 (birth registration) within the deadline registers the child into the Japanese parent's family register (戸籍), which establishes Japanese nationality. No separate residence status application needed for the child in Japan.

The Deadlines That Matter

Timeline After Birth

These deadlines apply regardless of which hospital you deliver at or how overwhelming the first weeks feel — mark them down in advance.


Within 14 days of birth
File the 出生届 (Birth Registration)
File at the municipal office covering your address, the place of birth, or (for Japanese nationals) your registered 本籍. Bring the 出生証明書 (birth certificate, issued by the hospital/doctor — usually attached to the same form), your 母子健康手帳 (Maternal and Child Health Handbook), and both parents' ID. This creates the baby's residency record (住民票) and, if a parent is Japanese, their family register entry.

Within 30 days of birth (foreign-parent babies only)
File 在留資格取得許可申請 at Immigration
Required only if both parents are foreign nationals and the baby will remain in Japan beyond 60 days. Filed at the regional Immigration Services Bureau covering your address — free of charge. You'll need the 出生届受理証明書 (certificate confirming your birth registration was accepted), so file the 出生届 first.

By 60 days of birth
Hard deadline — after this, the baby is an overstayer
If both parents are foreign nationals and you haven't filed the residence status application by day 60, the baby is technically in Japan without valid status. If you miss this deadline, consult a specialist immediately — options become more limited and may require a 在留特別許可 (special permission to stay) process.

Claim 出産育児一時金 through your health insurance provider, and start the process to register the birth with your own country's embassy — most countries require this for the child to hold that nationality and get a passport.
Long-Term Planning

Nationality & Dual Nationality

If your baby is entitled to Japanese nationality (one parent is Japanese) and also entitled to a foreign nationality through the other parent — or through that country's own birthright citizenship rules — they may temporarily hold dual nationality.

💡 国籍選択 (Nationality Selection) — the age 22 rule

Japanese law generally requires a person with dual nationality acquired at birth to choose one nationality before turning 22. This is a separate, later process — not something to resolve at birth — but it's worth knowing about early since it affects long-term planning (e.g., whether to pursue naturalization in the other country, military service obligations elsewhere, etc.).

If your baby will hold a foreign nationality, register the birth with that country's embassy or consulate as well — this is usually required to obtain that nationality's passport and is a completely separate process from anything filed with Japanese authorities.

No. The baby has no status of residence at birth and must be granted one through a separate 在留資格取得許可申請 filed within 30 days. It's common (but not automatic) for the baby to be granted a status matching a parent's — for example, Dependent Visa if a parent holds a work visa. This is a real application that Immigration reviews, not a formality.
Generally no separate Immigration filing is needed for the baby itself, since a child with a Japanese parent is typically a Japanese national from birth (once the 出生届 is filed) and doesn't need a status of residence. However, if the foreign parent's own visa status needs updating for any reason, that's a separate matter to check.
Contact a specialist immediately rather than waiting further. After 30 days (and especially after 60 days), your baby is technically without valid status, and the process to resolve this typically shifts toward a 在留特別許可 (special permission to remain) review, which is more involved than the standard application. Acting quickly and proactively — rather than waiting — significantly improves the outcome.
If your baby is entitled to both Japanese nationality and a foreign nationality, they can generally hold both — and both passports — as a minor.
