The Core Distinction

Two Ways a Marriage Becomes Legal Across Two Countries

When one or both partners hold a nationality different from where you're registering, your marriage needs to be legally valid in both countries involved. Japan handles this through two different processes depending on where you register first.

① Marry in Japan first
創設的婚姻 (Creating the marriage in Japan)
You submit a 婚姻届 (marriage registration form) at a Japanese municipal office. This is the marriage's origin point — it doesn't exist yet in your home country's records until you report it separately.

You already legally married under your home country's law (or a third country's). You then report this marriage to a Japanese municipal office or overseas Japanese embassy/consulate within 3 months.

Which Path Applies to You?

Most international couples living in Japan register their marriage in Japan first — it is generally the simpler route when at least one partner is already resident here.

Path 1: Registering in Japan First


Step 1
The foreign partner obtains a 婚姻要件具備証明書
A Certificate of No Impediment to Marriage (or an equivalent document) issued by the foreign partner's embassy or consulate in Japan, confirming they are legally free to marry under their home country's law. Requirements and processing time vary significantly by nationality — some embassies require a birth certificate or affidavit of eligibility first.

Step 2
Prepare and translate documents
The certificate (and any supporting documents in a foreign language) must be translated into Japanese. Any adult can act as translator — there is no requirement to use a certified translation service — but the translator's name must appear on the translation.

Step 3
Submit the 婚姻届 at a municipal office
File at any municipal office in Japan (does not need to be your registered address). Two adult witnesses (any nationality) must sign the form. Bring passports for identity confirmation.

Done — same day in most cases
Marriage is legally registered in Japan
Once accepted, the marriage is legally valid in Japan immediately. Request a 受理証明書 (certificate of acceptance) — you'll need it to report the marriage to your home country.

Path 2: Registering Abroad First, Then Reporting to Japan

If you married under the law of the foreign partner's country (or a third country), you must report the marriage to a Japanese municipal office or overseas Japanese diplomatic mission within 3 months of the marriage date, along with the foreign marriage certificate and its Japanese translation. Missing the 3-month window doesn't invalidate the marriage but does require an additional explanatory document at the time of the late report.

Japanese municipal offices do not automatically notify any other country's government when a marriage is registered. If you don't report the marriage yourself, it may not exist in your home country's official records — which can cause problems later for inheritance, name changes, or your own country's spouse visa/residency applications if you ever return.

What Comes Next

Marriage Doesn't Automatically Change Your Visa

Registering your marriage is a family-law matter handled by the municipal office. Your Status of Residence is a separate, immigration-law matter handled by ISA. Getting married does not automatically switch you to a Spouse Visa, and — importantly — it's not required to.

✅ Switching to a Spouse Visa is optional, not mandatory

If you're already in Japan on a valid work or student visa, you can continue on that status after marrying a Japanese national. Many couples switch to a Spouse Visa because it removes work restrictions entirely, but there's no deadline forcing you to do so.

If you do want to switch, you'll need to file a Change of Status application with your marriage certificate/受理証明書 as supporting evidence. If your foreign partner is currently outside Japan on a marriage visa track (i.e., entering Japan for the first time as a spouse), the process instead goes through a Certificate of Eligibility (COE) application from Japan, followed by a visa application at the embassy abroad.

Important Context

Same-Sex Couples — The Current Legal Situation

As of August 2026, Japan's Civil Code and Family Registration Act are interpreted by the national government as not permitting marriage between two people of the same registered sex — municipal offices do not accept a 婚姻届 from same-sex couples. Several high court rulings in 2024–2025 found the current legal framework unconstitutional, but no national legislation has changed as a result.

💡 Local partnership certificates exist, but carry no immigration weight

Many municipalities (covering the large majority of Japan's population) offer a パートナーシップ制度 (partnership certificate) for same-sex couples.
