✅ CONCLUSION
If you submitted a renewal application before your period of stay expired, you can legally reside and work for up to two months during the "grace period." If you did not submit an application, you will be overstaying, and you must consult an expert immediately.
What is the Grace Period?
If you submit a renewal application within your period of stay, this system allows you to continue residing under your previous status of residence until the results of the examination are issued (Immigration Control Act, Article 20, Paragraph 4). However, the maximum duration is two months.
| Situation | Residency/Work | Overseas Travel |
|---|---|---|
| Application submitted, under review (within grace period) | ✅ Permitted | ⚠️ Generally not permitted |
| Application submitted, grace period of 2 months exceeded | ❌ Not permitted | ❌ Not permitted |
| Application not submitted, period expired | ❌ Illegal | ❌ Not permitted |
🚨 If your period of stay expires without an application being submitted you will be overstaying (illegal residency) and subject to deportation. In this case, you should immediately consult the Immigration Services Agency or an expert. Voluntarily reporting yourself may lead to a reduced penalty.
Precautions during the Grace Period
If you plan to travel overseas, be careful. If you leave the country during the grace period, there is a risk that your status of residence will be extinguished and you will not be able to re-enter. Always confirm with an expert before traveling.
